    Let me help you get back to living life again without the stigma of this over your head for a one-time mistake.

    This includes all documents I will prepare for you.  The FDLE also has a fee that you will be responsible for.  At the time of this writing, 7-14-2024, the cost is $75.00. You will also be responsible for the cost of the Certified copies when the action is complete.

         (Packet):  $200.00

Even if the debt may be yours, would you like to be able to ensure you are not just sitting around waiting for a default judgment to be recorded?

    You can help yourself and stand up to these collectors while ensuring you have done your due diligence, instead of just giving up. If you don't try, you may have a judgment entered against you.  If you DO try......?

    Wills, Estates and Living Trust Documents

    Below are the options for estate planning needs.  I will prepare your documents based on written information you provide to me.

    1.  Last Will and Testament: A will is a document in which you state what should happen to your property after you die.  You can use your will to designate guardians for your young children, name an executor, and more.  If you die and you ONLY have a will, your estate will have to go through probate.  Any property in your name at the time of death will be held in probate until the action is completed.

         My package on this includes:

          * Last Will and Testament

          * Durable Power of Attorney

          * Advanced Health Care Directive (also called Florida Designation of Health Care                     Surrogate

         *  HIPPA Waiver

         *  DNRO (Do Not Resuscitate Order), if applicable

          Bundle price is $300.00 for all documents, for creating a will and the relative

          documents.

    2.  Revocable Living Trust:

         I will prepare your revocable living trust using written information you provide.

         * I can prepare the documents needed to fund the estate, as applies.

     or

         * I can provide directions for you to handle all on your own.

            Bundle price (includes all docs listed under Last Will and Testament above AND also          includes the living trust):  $450.00, this includes my assistance in funding the trust.

            or Fund on your own: $400.00

     A common question is, "What if I already have a will but I don't have a living trust"? Can I start a trust with the will I have"?

    Answer:  Yes, you can.  It would help to review your current will and determine if any changes should be made first and proceed from there.  If you have previously used an attorney to draft your last will and testament, it is your option to ask them for assistance in making any changes.  However, you do not need an attorney to create a will in Florida.  You may choose to proceed Pro-se.  I can help with that.

    A Florida Revocable Trust is established during a person's lifetime and is revocable.  This means you can make changes to it and needed.  Any omitted assets can be transferred into the trust at the time of death through a Pour Over Will.  I will provide this document with the trust package, as it should be part of any living trust document package.

    LLC Formation

    There are two options to choose from:

    1.  Documents prepared to open and register the LLC:  $50.00

    or

    2. Documents prepared to open and register the LLC AND apply and get your EIN

        (Employer identification) number:  $70.00

    Chapter 7 Bankruptcy

    Article 1, Section 8 of the U.S. Constitution authorizes Congress to enact "uniform laws on the subject of bankruptcies."  Under this grant of authority, Congress enacted the "Bankruptcy Code" in 1978.  The bankruptcy code is codified as title 11of the United States Code and has been amended several times since its enactment.  It is the uniform federal law that governs all bankruptcy cases.

    Who can file under Chapter 7 Bankruptcy, [11 U.S.C. §§ 101(41), 109(b)]

    Chapter 7 - Bankruptcy Basics | United States Courts (uscourts.gov)

    An individual, partnership, corporation or other business entity.

    What is a Chapter 7 Bankruptcy and how does it work?

    Entitled Liquidation, contemplates an orderly, court-supervised procedure by which a trustee takes over the assets of the debtor's estate, reduces them to cash, and makes distributions to creditors, subject to the debtor's right to retain certain exempt property and the rights of secured creditors. Because there is usually little or no nonexempt property in most chapter 7 cases, there may not be an actual liquidation of the debtor's assets. These cases are called "no-asset cases." A creditor holding an unsecured claim will get a distribution from the bankruptcy estate only if the case is an asset case and the creditor files a proof of claim with the bankruptcy court. In most chapter 7 cases, if the debtor is an individual, he or she receives a discharge that releases him or her from personal liability for certain dischargeable debts. The debtor normally receives a discharge just a few months after the petition is filed. Amendments to the Bankruptcy Code enacted into the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 require the application of a "means test" to determine whether individual consumer debtors qualify for relief under chapter 7. If such a debtor's income is in excess of certain thresholds, the debtor may not be eligible for chapter 7 relief.

    I'm a BPP (Bankruptcy Petition Preparer). I'm not an attorney and can not give legal advice or representation.  What is a BPP?

    A bankruptcy petition preparer is by definition any person or business, other than a lawyer or someone who works for a lawyer, that charges a fee to prepare bankruptcy documents. A bankruptcy petition preparer generates bankruptcy forms to file based on the information the customer provides in writing.

    My fee for Chapter 7 Bankruptcy (Florida only), is $175.00.  This does not include the cost of court case filing fee, the miscellaneous administration fee, or the trustee surcharge.  The total of those fees are currently $306.00.

    If you need help with any other documents, please reach out to me.  I may be able to help.  Just ask.
